ILR on Five year Route

My Partner has got her spouse visa on 13/01/2014 and entered in this country on 24 January 2014. Her first visa was issued for 33 months and then got another 30 months on 06/12/2016 which applied on 04 October 2016. The other 30 months expires on 15-06-2019.

we Just wondered when my partner can apply for ILR as she has fulfils the 5 year residence in January 2019.

Do we need to wait until the expiry of the current leave or can we apply when we fulfil 5 years lawful residence on the same visa.

She can apply no sooner than within 28 days before 24th January, the 5th anniversary of her date of entry to the UK.
