ADVICE ON FINANCIAL REQUIREMENTS

Post by bbial » Tue Oct 02, 2018 3:20 pm

Hi,

I'm am a Sponsor to my wife who will be applying for a Spouse Visa from Pakistan. As I'm a director/employee of a limited company I will have to submit CT600 for the last FULL financial year. My last tax return was done on 7 November 2017 and therefore my year is due to end on 7 November 2018. I have taken advice from a solicitor that because I want to apply for the visa ASAP, therefore, I want to shorten my period from November 7, 2017 - September 30, 2018, and he has shortened the period in HMRC.

Now the question is since UKVI requires LAST full financial year will they consider the period mentioned above as last full financial year or will they reject the application by saying the CT600 is not for 12 months but instead it's for 10 months since you've shortened your financial year?

Secondly, I have so far earned £9499.98 this year (break down: I have started taking a gross salary of £1583.33 a month starting from April 2018. So a total of 6 months starting April - September 2018 will make £9499.88). The requirements say I have to earn £18600 a year, therefore, I'm taking a dividend of £9500 which I'm eligible to make £18600.

The guidance also says that all the earning should be under the period of CT600 which is November 7 2017 - September 30, 2018, and must reflect in your personal bank statement. The wages of September 2018 which just finished will be taken on October sometime and the dividend will also be taken in October. The last salary and dividend money will reflect in October's bank statement which technically is taken after the CT600 period. Is this a violation of guidance?

Please advice on this as these are the only loophole in my application.

Regards,
Bilal

Advice on Accommodation requirements.

Hi,

I'm applying for my wife's visa maybe this week. I want to know a little more about accommodation. My brother owns a first-time buyer studio flat which he bought this July. Now since the flat is in his name how should I proceed with me and my family living there? My solicitor told me that I should be asking my father and brother to produce with the following letters:

Father letter:

Dated : 4th December 2018

To,
UK Visa and immigration
Spouse visa Entry clearance Department

Dear Sirs,
I ** bearing date of birth * a British national currently residing at ** which is a 3 bedroom reception room. I am currently staying here with my wife Mrs ** , son Mr ** , son Mr ** and daughter Miss ** all of whom are British nationals. We are a very close knit family and have always lived together. I have always have been of the opinion that once any of my kids get married they should live their independent life so the relation ship stays strong. In July/august this year my son ** who currently resides with me purchased a flat with address **. The property was a good investment hence was purchased with thoughts of either we rent it or Bilal who has got married recently would move. Bilal moved in the property from ** with the idea that he would live there with his wife. I advised my kids to be clear with financial transactions hence Bilal pays rent £650 a month to my other son ** who owns the property. A rental agreement was drawn on ** for an understanding between them and also for the purpose of the visa. I understand the land registry document takes few months and he has not obtained the same but he has included other relevant documents to prove his ownership.

I have enclosed my passport copy along with this letter and if need any further information don’t hesitate to contact me.

Does this satisfies that my brother is renting me the flat and I can keep my wife in it? If anyone can show me via guidance this is exactly what UKVI is looking for, I shall be thankful.

Regards,
Bill
