Long Residence (10 Years) - Discretions to break in continuous residence?

Post by Mk17 » Fri Dec 07, 2018 4:39 pm

Hi All,

Request you all to help me with your valuable suggestions.

I came to the UK on October 2008 to pursue my masters in an elite university. [Tier 4 Student - 16 months]
Immediately after finishing the course, I found a job & worked full time at a top Automobile company.
Switched to Post Study Work permit in Jan, 2010 [Tier 1 PSW - 24 Months]
One of the big IT companies in India offered me key position in December, 2011. I moved to India.
The same company then transferred me back to the UK on Tier 2 ICT short term visa, issued on June 2013. [Tier 2 ICT Short Term - 12 months]
My company later renewed the visa in June 2014 for 3 years. [Tier 2 ICT Long Term - 3 Years]
Again renewed my visa for the last 2 years under this category on June 2017 [Tier 2 ICT Long Term - 2 Years]

I am now nearing 6 years of continuous residence in the country, but since it was under ICT it does not count. Also, I have a gap of 18 months between - January 2012 & June 2013.

However, wanted to check any discretions for the 10 year route? Paid taxes promptly, NI, Bills, Been a good resident, working at senior managerial level (earning £75k) in a FTSE Top 20 Company.

Thanks
MK

No discretion. An 18 month gap breaks your long residence continuity. Any absence of 180 days or more does for 10 years long residence.
