Is this considered breach of immigration?

Post by Pivi » Mon Dec 10, 2018 6:34 pm

Hi,

I’m a new user, please anyone can help me answer my question?

I will be eligible to apply for ilr and citizenship in a few months based on tier 2 dependent route, but so worried that the application may be rejected due to overstaying in the past 10 years.

I first came to the UK on tier4 (Pre-sessional English) which expires on 23/10/2011, after that I extended it but due to wrong payment information it was returned to uni so needed to amend and apply again, then second tier4 was granted on 14/12/2011.

From above situation, is this period of about 50 days gap considered overstaying and going to cause refusal of both applications?

Any suggestions would be greatly appreciated.
Thank you very much.

Thank you for your comment.

I don’t know the exact dates, but I’m sure that the first renewal application was made before the expiry date and fresh application was also submitted within 28 days after rejection. If this is the case do I need to request this information regarding exact submission dates from Home Office so that I can send them as evidence and they can apply waive for breach of immigration when I make citizenship application?
