UK Spouse Visa and Passport Pass Back

Hi there

I will be applying shortly for a UK Spouse Visa and will use the premium service of keeping my passport while a decision is being made. I am wondering if anyone is aware of whether a person can travel to the UK for tourism/business while their settlement application is under consideration?

Yes you should be if you are a non-visa national and can satisfy entry clearance officer.

Thanks for your feedback. That was my thinking as well. Since posting, I found the UKVI email that costs 5 pounds to use and thought I would enquire. This is the response I just received:

"With regards to your enquiry, please be advised that you will not be able to travel to UK when you have a visa application under process with the Home office."

Unsure whether they took into account I was a non-visa national. Does anyone have personal experience with this?

You need to satisfy the IO that you are a genuine visitor, which you won't be considered as due to your application in process to settle in the UK. They will be able to see that you have a settlement visa under consideration in your home country and you could be denied entry and returned. They will view your visit as an attempt to circumvent the immigration rules, as many have tried to do and failed who are non-visa nationals.
