Help with advice for mum's case

Suggestions for my mum work/visa

Hi everyone,

My mum is a qualified nurse that currently works in Abu Dhabi.
She has been a Registered Nurse for over 30 years. She is also certified to take radiographs (x-rays/CT scans etc).

I have looked into non-work related options but nothing qualifies as I am not under-18 (Family visa) and my mum isn't physically or mentally unstable (adult dependent visa). I'm guessing the work path would be her only option.

I would really like her to join me in the UK in whichever way is the easiest route to take. I was hoping for your suggestions on what we should do.
I am 24 and in full-time employment, I can financially support her and have a 2-bedroom flat for her to reside in. I am a British citizen (father was British, he passed away in 2012). I have been living in the UK since 2007.

There is only the Tier 2 General visa if she can get sponsorship from an HO approved sponsor and meet all the relevant requirements. If she can get an employer to sponsor her, she has to work and will be limited to absences. She can also only work for her sponsor on their PAYE.

Hi everyone,

I just wanted everyone's advise on my mum's situation.

My mum is 54 and currently works in Abu Dhabi as a nurse.
I am a British citizen (my father was British) and have lived in the UK for over 10 years now. I am 24 and work a full-time job and have suitable accommodation and savings if it is a criteria.

My dad passed away in 2012 and I have since been alone with no other familial ties in the UK. My parents are married and in fact got married over here. They were going to apply for the spouse visa however my dad got very sick and passed shortly afterwards which left us in a bit of a struggle. They have been together for 22 years until the point of his passing. She has a long-term visit visa and has been able to visit me from time-to-time. She has recently met a British man who she is in a relationship with at the moment, they have been together for 1 year so far but only meet when she is here visiting as he resides in the UK too..

I have read through the GOV website about the visa options and the only one that seems optional is the tier 2 working visa. Are there any other options that would be viable in her case?
We spoke to a solicitor who mentioned about a long process of trying to apply for discretionary leave to remain but i'm not sure how reliable/guaranteed that would be, they said it could take 2-3yrs and i'm not sure if our case would be strong enough for consideration.

I would be most grateful for your help/suggestions.

Your solicitor should be aware that an Adult Dependent visa is one of the most difficult routes to settlement. Since the Immigration Rules were tightened in July 2012, very few applications have succeeded and the majority of those have only been granted after a lengthy and expensive appeal through the Courts.

Unless your mother needs daily help for basic tasks such as bathing, dressing, preparing food etc., the application will fail. Also, that care can not be available in her country of residence, or is not affordable.

If your mother submits an ADV application and it is refused, any chance in the future of entering the UK as a visitor will be lost, due to the previous intention to settle.
