ILR Application on FLR(DL)

Hello All.
Just needed an advice on my issue.
Seek asylum in 2009 and was refused but granted DL in Aug 2012 for 30Ms after HO not willing to proceed to court hearing in Dec 2011. Renewed in 2015 also for 30Ms and applied for ILR in 2018 but was told in a dated letter that i haven't completed 6 years DL and would be considered for an extension and granted another 30Ms from Oct 2018 till 2021 with excess fee refunded.
Pre-Action Protocol letter submitted to challenged SSHD decision because letter to vary the application was submitted when i clocked 6years during passage of time but nothing was done.
Response:
''However, as explained in the sshd decision letter dated 30th April2018, it was noted that as your client has not completed 6 yrs continues DL, therefore he is not eligible for a grant of ILR''. Then refers to guidance notes.After that the letter ended in a way i do not understand.
''your client first grant of DL was on 29/08/12, hence he fails to meet the requirement for ILR on the six yr route.
The SSHD decision dated 30/04/18 is therefore maintained.
Do you think i should go ahead and apply by tone of the letter?
