Help - When should my wife apply for FLR(M)

Post by Adonis » Sun Jun 08, 2008 9:20 pm

Hi, I'm a British citizen married to a wife from another country, she applied last year for form SET(M) but she has been given a 1 year visa to stay hear and complete the 2 years time. But it now looks that the rules have changed and she needs to pass the Life In The UK test to get the get it. So her Visa expires on the 22 of July this year and she needs to apply for an extension visa to study and pass the test. But we have one question.

When should we apply for FLR(M): -
- Now?
- One month before her visa expires?
- One day before it expires?

Thanks, looking forward to hear from you.

To start with your post is confusing.
she applied last year for form SET(M) but she has been given a 1 year visa to stay hear and complete the 2 years time
Was she already had 2 years spouse visa before? Did she delayed her travel when she first arrived to UK? If so how many days?
But it now looks that the rules have changed and she needs to pass the Life In The UK test to get the get it
Yes, she needs to pass life in the UK test before applying to ILR.
When should we apply for FLR(M): -
- Now?
- One month before her visa expires?
- One day before it expires?
Again your question is bit confusing here. You said HO already gave an year extenstion when you applied for SET(M), As I understand if she got extension of 1 year on top of 2 year spouse visa then she should be eligible for ILR. If thats the case then she can apply as long as she full fills the requirement of 2 years period on spouse visa and the life the UK test with all the other supporting documents. It would be helpful if you can post the dates of her visas both valid from and expiry.
