FLR FP APPLICATION -both parents overstayed

Hi there. Need some help URGENT..
My daughter and partner applied for flr fp as a single mother last october 2015. At that time ny,daughter is.in/out of hospital cause she was diagnosed with crohns disease. That application was refused and all appeal rights exhausted. Luckily, we were able to register my daughter as british citizen before the last appeal.
My.question are:
-can my partner and I apply for.flr fp on basis of a british child or still apply my partner as a single parent?..
-if we will apply together, can we just tell home.office that we were wrongfully advice by our first solicitor and provide all,doucments that we really.are a family unit?

At the time we opted to.file as a single parent cause hospital are.asking for my.daughters status
