Cooling Off for Tier 2 General from Tier 2 ICT

Hello,

It will be great if someone can clarify if Cooling Off applies in my husband's case

He's been in the UK for the last 3 years (almost) on a Tier 2 ICT Long-term Staff Visa and has applied for extension already as it will expire very soon.

Can he apply for a Tier 2 General Visa (once ICT is extended) in case another company in the UK makes him an offer and agrees to issue a CoS?

I have read the guidance document and checked out a lot of discussion boards but I'm still not sure …

He can, after the 12 months cooling off period, which starts counting from the date he leaves the UK.

The only time the cooling off period is waived is if he is offered a salary in excess of £159,600pa.
