Is there anything wrong with this?

Post by cog11athome » Wed Mar 27, 2019 8:06 pm

I am wondering if I have made any mistakes that could cause a refusal. I would appreciate if you could check my evidence and let me know if you can spot any issues. I am applying for a visa for my same sex partner from China as a fiance at the end of may or early June.

I have included the ways in which I plan that we will meet the main parts of the application. We are 100% confident we totally meet absolutely everything however I am very fearful of the HO and how picky they can be so I really eager to be very careful.

Financial
I am applying under category A having been with my employer for over 6 months working as a secondary school teacher. My salary is £23,720 but each month is a little more as I do the odd bit of overtime but never ever less than £23,720 (i.e. I am salaried at that with optional overtime). I am also self employed but intend only to rely on my salaried income. My total income is over £40,000 but I only intend to rely on what I need rather than having an super complex application.

I take it that 6 payslips, bank statements and a letter from my employer will be enough evidence.

English Language

Simply submit a masters degree certificate from a UK university that my partner has to satisfy rule.

Relationship
Lots of photos, chat longs going back to 2014, letters from my dad and aunt backing up our relationship, trips to UK, joint holiday evidence, statements from each other, shared AMEX credit card.

Is this enough evidence?

Intention to Marry

Provisional booking from registrar, supporting letter from friends and family, covering letter. We plan to get married in October as we have no idea how long the visa application will take to get approved and as I teach and hence we want to marry in one of my holidays.

Accommodation

I rent a one bedroom house. I have a no objection letter saying my partner can move in. Only issue is its a 6 month tenancy ending on the 8th of June and we plan applying around this time. I am moving to a new city in September so I don't want to extend 6 months and I can't bare having my partner away until I move.

Is a rolling contract enough? Should I wait until I get a new contract in June or just get it mentioned that it goes month to month on the letter. I can't believe that someone with a

We will also get a TB certificate and the other stuff we have been told we must have

Could you please advise if there is anything we need to do to improve our chance of success. The separation and bureaucracy of this is causing us sleepless nights and a huge amount of stress and depression. I constantly worry that our lives will be wrecked over section 101 part 2.4.1 section 3b part 5.2.4c.6 paragraph 2.1 on page 957 of some document we have never heard of!

Before I answer some questions: Is this a Fiancee visa or Spouse visa? As you say you may get married before approval, is your partner already in the UK? I am a little confused how you will be getting married before the visa which allows you to get married is approved?

But going on that this is a fiancee visa, though I would check you can marry before visa is approved as you do need one for a foreign national to marry a British Citizen (or for two foreign nationals to marry)

I take it that 6 payslips, bank statements and a letter from my employer will be enough evidence.
A work contract is also helpful. If payslips are printed then there needs to be a letter from your work saying they are true copies. If bank statements are printed then need to be stamped by bank.

I believe you only need two years worth of evidence, they do not want the whole relationship.

Back when I applied for fiance, i also added wedding invite, ring receipt, dress receipt etc.

The letter should be fine if you need to apply before moving in together though I would suggest writing a letter explaining the situation if full. Maybe if someone else can answer but maybe waiting till you are living together in a new flat might be better but at the same time if that can not happen then just give your tenancy agreement, letter from landlord and full explanation of situation

I also included letters of intent as a part of showing our length of relationship. Also anything you are slightly worried about/dont have, explain in full from yourself and just be honest

All my answers are based on my own experience and may differ from your own.

I am a British Citizen applying for a fiance visa. My partner is in his home country. We plan to apply in May/June and then get married in October in the UK once we have the visa. Your helpful comments are much appreciated.
