Rights of EU children vs children born outside UK to British parents by decent.

Post by Shaun45 » Sat Mar 30, 2019 8:11 am

I have decided to start a separate thread rather than continue from my previous one regarding the MN1 child application here: https s://www.immigrationboards.com/immigration-f ... l#p1761729

This is to get the general opinion and possible changes post Brexit.

I'm of the opinion that the rules regarding citizenship for children born outside the UK to British citizens by decent seems a bit unfair. Particularly the MN1 3 (5) application.

In other words it seems children born in the EU to EU parents have more rights and privileges than children born to parents that are both British by decent and have more British blood than these EU citizens. All the hoops you have to jump through and the cost to get citizenship for your child is ridiculous. It just seems unfair.

Apologies for the rant but this is what I have realised unless I'm missing something.

I wonder how things will change in this regard post Brexit? Opinions welcome.

Brexit will not change UK nationality laws.

One can always hope for a more equitable and just system with regards to what I mentioned.

An interesting aside is the developments between the CANZUK countries happening at the moment that will reshape the landscape between the UK, Canada, Australia and New Zealand. Things like free movement of citizens of these countries, trade, defence and more.

British law on immigration and citizenship is generally much more precise and specific and has higher requirements than EU law.

For instance, British citizens are required to earn a minimum of £18,600 in order to sponsor a foreign spouse to migrate to the UK. There is no such requirement for EEA citizens, whose non-EEA spouses have the right to accompany them even if their EEA citizen spouse is earning a minimal amount.

It is likewise with children of British citizens by descent and EEA citizen children.

However, EEA citizens, including EEA citizen children, have to meet the same requirements as non-EEA citizens if they wish to acquire British citizenship as the acquisition of British citizenship is governed entirely by British law.
I am not a lawyer or immigration advisor. My statements/comments do not constitute legal advice. E&OE. Please do not PM me for advice.

A dearly beloved to the core!!!! Obviously you were an ardent supporter of apartheid in South Africa and now want to introduce race and bloodline in the UK immigration system.
The British have been dearly beloved enough to accommodate Saffies of British origin here and after 3 generations they still want to claim rights of return. Like their parents never left the UK for "better" prospects and when things turn sour, you feel ur superior blood should give you the right to come back and claim everything.
Now you want to propagate the myth of CANZUK being a new Union of White Ruled countries of the once British empire. A superior commonwealth. There are a lot of commonwealth citizens of Indian Origin who lost their claim to British citizenship because they moved to India instead of UK when they were evicted from East Africa and Britain introduced new laws and the consulates stopped renewing their British passports forcing them to apply for Indian citizenship and later claiming that applying for Indian citizenship automatically is considered renunciation of UK citizenship.
Shaun u deserve nothing and I hope the UK govt finds some reason to deny your kind a British passport.

I find your response offensive and insulting. I am merely stimulating debate on the subject. No need to get personal.
