Spouse visa for my Chinese wife

Hi,

I'm a British national who's looking to get a spousal visa for my wife. We also have a daughter together, but I've already got a UK passport for her. However, I've got a few questions about making the application that I'd love some help about.

1. We got married in China, so our marriage certificate is in Chinese. However, we already got it formally translated it for our daughter's UK passport. If the translation we used for that was accepted, will it be ok for this too?

2. What should we say about our daughter? She was born in China, but she's a British citizen by decent and has a passport. Do we need to send any documentations about her?

3. We were living together in China for 3 years, however, it was with my wive's parents, so we didn't pay any rent or bills together. We don't have any documents that explicitly show we lived together, just her hukou (which shows where she is registered to live), and my foreigner accommodation registration. What else can we produce?

4. She's been with me in the UK for the past 5 months on a visitor visa. We have a joint tenancy, and council tax bills with both our names on, but not much else. Will this be a problem?

5. I easily make the required money for the financial requirement, but I also receive regular money from my father every month - what should I say about this?

Any help people can give me about these issues would be greatly appreciated!

Is she applying for her spouse visa from her home country?

1. Should be fine yes.

2. The online form will say if any th ING is required.

3. Not required. Proof of relationship etc is required and mother in law can write a letter if you want.

4. Cohabitation is not required for an initial spouse visa. How did she get out onto a tenancy as a visisotr visa holder and not a proper leave to remain visa required for the right to rent checks?

5. Nothing to say if your income mets the requirement and you submit the evidence.

With regards to the tenancy thing, I'm not sure - I was very open about her visa status, and the agency didn't come back with any problems. In fact, I wasn't aware she wasn't allowed to be on it.

She's not down as paying any share of the rent, she's just named.
