Can i be subject for refuse??? need an advice pls

Post by ItrustinGod » Tue Jun 04, 2019 9:58 am

Good day to all!!

I start my story on 2010 when i met my partner we are both student visa without no recourse on public funds back in the day we dont know anything about that rules and what it means. we had a baby on the next year on 2011 and start claiming child benefits on 2012. Unfortunately HO refuse our application on student visa brcause of the school problem and by 2015 HMRC stop the child benefits as we dont have proper documents and by 2017 they told us to pay back the whole amount we receive since from the start. But unfortunately that time we are not allowed to work so we cant pay it back.
this year we try to apply a new application again and Thanks to God its approve as private family life.

My QUESTION is:

1. is that child benefits claim will be affected our visa renew on next 2 and half years? even we are happy to pay it back

2. can they used that to refuse our visa extension on this new approve visa we had? even we done it on old student visa we had before

If you both were student who only should be allowed to work 10-20 hours per week with no recourse to public funds then how you were able to claim child benefits? Had you given true information to claim benefits?

Were you prosecuted or cautioned for benefit fraud? If not then it will have no impact directly on an extension.
The issue is likely to be when you apply for ILR and onwards to citizenship then they may state you are not of good character and deny citizenship for an extended period. But all that is a long way off.

Hi Frontier Mole
They did not mention any fraud or something in the letter the only thing they want is pay the overpaid benefits and thats what we are going to do now.

hi Seagul,
Yes your right 10to 20hours only the hospital gave us the form and we signed it true and correct with the copy of our visa indicated that no recourse in public funds if they told and educate us in the first place we are not going to claim anything but we are going to pay it now.
