HI all,

Really sorry if I have posted this in wrong place. Desperately need some advice. Really stressful times.

My son who was nearly 3 and I came to UK in Feb 2014 to join my husband, outside the rules with leave to remain under HRA8 expiring Aug 2016 (2.5 years visas) as we could not meet financial requirement at the time of application.

In Aug 2016 we applied for leave to remain under five year partner route, met all requirements and granted 2.5 years expiring April 2019.

We have a British son also who was born in UK in 2017.

Without realising our first 2.5 years don't count as it was granted under outside rules we applied for indefinite leave to remain set(m) in late January this year because ( I know now wrong assumption) we thought we successfully completed 5 years and provided all the relevant documents including financial requirements.

After long wait this month we were asked to send our British born son's passport etc by our case work and we did. And next thing we have received is a letter explaining we don't qualify for indefinite leave to remain and offering limited leave for 30 months instead. And also asking to pay £2000 health surcharge which I have.

Now we are waiting for the visas of 30 months. We are all gutted and it has been very stressful.

Now my worst fear is if they would put us on 10 year route. in 2016 we successfully granted visas under five year route and applying for indefinite leave this year is a genuine but massive mistake. So I would have thought 30 months we shortly will be getting completes our five years and in another 2.5 years time we could apply for indefinite leave ( 7.5 years in total since we came in 2014). Or won't this be the case? We will be heart broken if they put us on 10 year route. Any advice much appreciated guys. Thanks a lot.
