Qualifying period in VISA switches

Hi,

I have been on Tier 2 General Visa for over 20 Months. Now I have got Endorsement for Tier 1 (Exceptional Talent) visa and need to decide how long to apply for, which will be included in .

In this scenario- I was wondering if my Tier 2 visa will be counted toward 5 year Qualifying period for ILR or not? If not, I better apply for 5 years of Tier 1 VISA.

Please advice if Tier 2 to Tier 1 switch will be considered continuation or not for ILR?

Both visas are completely different and you cannot combine the times spent on them to get Ilr.

Both visas are completely different and you cannot combine the times spent on them to get Ilr.
@ seagul, yes you can. There are very specific rules for tier 1 exceptional talent route. Please read up on the PBS route rules and guidance before advising incorrectly.

You may only combine providing the most recent period of leave is spent as a Tier 1 Exceptional Talent or Promise migrant.

Which for the OP will be the case when the time comes to apply for ILR. :idea:

Thanks for your help.

Yes, when I will apply for ILR (3-4 years down the line), I will be on Tier 1 Exceptional Talent.

That means I can apply for 4 years Tier 1 and combine some period from Tier 2.

Would my spouse will also be able to combine this periods (as she is and she will remain dependent on me for this whole period) ?

Yes, she simply needs to hold a PBS Dependent visa for 5 years to qualify for ILR.
