Tier 2 Dependent Visa Extension (Husband taking ILR-10 year route)

Post by reza1363 » Sun Aug 04, 2019 8:13 am

Hello Team,

Much appreciate if anyone can help advise on the below questions.

My husband is now eligible to apply for his ILR on the basis of 10 years long residence. In addition it is 4.5 years that we both are on Tier 2 (General) visa sponsored visa.

Could you help us with-
1. If he applies for ILR (on basis of 10 years) NOW, what will happen to my current tier 2 dependant visa? do I get to extend under Tier 2 dependent or have to change my visa type to ILR dependent - if its later then do my 5 years start again?
2. Could you help with link to apply for Tier 2 dependent and also any reference (this forum or other sites) to documents required.

Thanks alot for your taking time to help me in this matter.

1. If he applies for long residence ILR, you cannot stay on or extend your tier 2 dependent visa. You will have to switch to FLR(M) and meet the English and financial requirement. It will reset your 5 year clock for ILR to zero.

2. Not relevant as you cannot extend as a PBS Dependent if your spouse applies for long residence ILR. The rules changed more than 5 years ago regarding this.

Thank you so much for your quick reply. Does that means that the best way to get ILR for both of us is that we both stay till the end of our 5 years on Tier 2 and then apply together?

Cheers
