My wife is foriegn and I am a UK citizen.
We applied to extend the flrm visa that we had already had for the first 2.5 years.
As we have been waiting for the decision for a while my wife's visa has now gone beyond its current end date whilst we wait for a decision.
We were shocked today to find an email from the home office saying our application is invalid and we are required to submit the sponsor deceleration within ten days otherwise the visa will be refused and my wife will be required to leave the country.
we contacted the upload visa centre to be sure, we made them read out all the documents we had uploaded (despite the 2.50 per minute fee) to be sure. And sure enough we had uploaded everything including the deceleration form that the home office said was missing. The woman on the phone assured us we had uploaded everything on the checklist and that it's something we have to discuss with the home office and not their problem.
So we are now in a strange twilight situation Where the upload centre assures us they sent the docs to home office and the home office says they hadn't received one of them.
Even though the solution seems simple, just send the requested document. We are feeling very uncomfortable as we are worried they haven't received other documents/evidence and worried as to what else could be amiss. Or whether sending the document will even remedy the situation or if they will somehow miss place that one also.
We were wondering if we should respond to the request via email, or via post? and whether there is anyway to prove that we have uploaded the documents? We didn't get legal advice to begin with as we didn't the first time and assumed it would be straight forward to extend but would we be advised to get legal advice now that the home office is saying they don't have documents that they do have?
