While traffic offences have been asked numerously, I think civil court case has never been asked here, hence starting a new topic.
Background: I have initiated a court case against someone with the Circuit Court.
Question: should this be disclosed in the application form & how would this impact the application? Have anyone received clarification from INIS on this topic , and what was the outcome of your application?
Relevant sections in the form 8:
1. It was asked at question 11.3 “Do you have any convictions in the State or any other country (including traffic offences) or any civil judgements made against you?” - I would tick No because I am the Plaintiff. Other than this part, no where else in the form asks for disclosure of civil Court case. So I guess I’m good on this question.
2. However, it was stated on page 8: “Applications where the applicant has a case pending in the court system will not be processed until the matter is concluded. Therefore do not submit an application for naturalisation until the case is closed.” I do not know if this refers to both criminal & civil cases. To me it doesn’t make sense to include civil case (I should be able to protect my rights), but the wordings are ambiguous. Thoughts?
In addition, I read on Citizensinformation website, that all criminal & civil cases should be disclosed - but nowhere in the form 8 ask for such disclosure (unless civil judgments were made against me). So I’m not sure if this website was accurate about that.
