PBS Dependant Extension for Spouse when I have ILR (IHS Surcharge)

Post by UKConfused89 » Sun Sep 01, 2019 8:51 pm

Hi,

This has likely been discussed here before, but I'm trying to get a clear answer to this question.

The situation:
  • I've been in the UK for some years and got my ILR in Nov-2018 on the Tier 2 General route. My ILR expires in December 2024.
My wife's PBS Dependant visa expires in Nov-2019, so she needs to apply for an PBS Dependant extension. She becomes eligible for ILR in Jan-2021.
The issue:
The IHS Surcharge is now £400 per year. She only needs a two year extension to her visa (as she would likely have obtained ILR within two years). However, when she enters the correct expiry date of my ILR, she has to pay £2,000 in IHS (for the 5 years until 2024).

Is there a way to "restrict" this (and her visa) to two years?

I have seen posts on this forum about just writing a different expiry date for my ILR, but we don't want to be screwing around with the Home Office by literally providing incorrect information!

Has anyone been through this experience and can share some guidance? I would be very grateful. Thank you.

To get the correct IHS amount you need to state the expiry date of your ILR as 3 years.
The opinion expressed as above is neither a professional advice nor contesting/competing to other member's opinion/advice.
