Tier 2 General and ICT, PR application

Hi All,

I am on a Tier 2 General visa and have completed 1 year in the UK on this visa.
My spouse is on a Tier 2 ICT visa which expires in October 2021.

There are 2 questions that I will need help on please:
1. Am I allowed to apply for a PR towards the end of my 4th year or will I need an extension of my visa (Tier 2 General) for 1 more year from my company in order to do this?
2. What will be the implication on my spouse's PR application if she continues on her Tier 2 ICT until the expiration of her visa? Can I convert her to a dependent on my visa for the last 2 years and will she still be eligible to apply for a PR?

PR is under the EU/EEA rules. You would be applying for ILR under the UK immigration rules. You can apply for ILR no sooner than within 28 days before the 5th anniversary of the initial visa issue date.
2. What will be the implication on my spouse's PR application if she continues on her Tier 2 ICT until the expiration of her visa? Can I convert her to a dependent on my visa for the last 2 years and will she still be eligible to apply for a PR?
She needs 5 years residence on a qualifying visa, i.e. Tier 2 Dependent, before she can apply for ILR. ICT does not count for ILR based on 5 years residence and she also cannot combine ICT and Tier 2 dependent to make 5 years for ILR. There is no '2 years visa' route to ILR. Not sure why you believe this. It is 5 years for ILR.

If her get her Tier 2 General Dependant visa processed now, she would have completed only 4 years when I apply for my ILR.
Am I allowed to extend her dependent visa along with my ILR apllication please?

Yes, it would be a 3 year extension.
