28 days calculation - visa issue date vs date of entry

Post by ccoriander » Sat Oct 12, 2019 1:12 pm

Hi,

We're currently on the Tier 2 general visa (main + dependant) and coming up to ILR application time. We've read the guidelines a few times, but would like to confirm if our understanding is correct regarding the application date.

Our Tier 2 visa is "valid from" 28/11/2014
We arrived in the UK on 18/01/2015
(51 days after visa valid-from date)

Referencing: https://assets.publishing.service.gov.u ... 9.0ext.pdf

"Breaks of leave and allowable absences
For any acceptable breaks of leave, the period spent outside of the UK will count
towards the 180 days allowable absence. This includes any time:
• while their leave remains valid
• after the expiry of their leave
• while the entry clearance application was under consideration
• before they entered the UK once entry clearance had been granted"

Based on the above information, we believe we can apply for ILR 28 days based on the visa valid-from date
i.e. 28 days before 28/11/2019
i.e. 31/10/2019

Does this seem correct to you?

Thanks

p.s. we were away for only a handful of days in the first year, so we're well under the 180 days absence limit even with the 51 days inclusion here.

That would be correct yes. You can apply within 28 days before the 5th anniversary of the initial visa issue date.
