Tier 2 switch employers - ILR

Post by Sumi2223 » Fri Oct 25, 2019 4:51 pm

Hi,
I have been on a Tier 2 General Visa for 3 years and am about to switch employers. The new employer will also sponsor me under Tier 2. My question is, will the past 3 years still count towards the 5 year route to ILR? Is there any requirement for ILR that says I must have been with my original sponsor for 5 years? I've searched gov.uk articles but could not find a definitive answer.

Thanks

Yes, why do you believe it won't?

Thanks. My spouse has also completed 3 years under Tier 2. If he decides to quit his job now and switch to a dependent spouse Visa instead, how will that affect his route to ILR? Given that it would take me another 2 years to get an ILR myself.

Yes it will. He cannot combine time as tier 2 general main visa holder and tier 2 dependent time to make up 5 years for ilr. You need 5 years as tier 2 main visa holder or 5 years as PBS dependent holder.

If he switched to dependent, when you get ilr he will apply for a PBS dependent extension which will be for 3 years.
