Dependent Spouse Visa

Post by cvs10 » Thu Nov 14, 2019 1:05 am

HI All,

I will be applying for my future wife-to-be for a Spouse Dependent Visa in January 2020. Currently I am an ILR visa Holder or might be Citizen of UK by the time of application. The financial eligibility is to show 18,600 pounds PA earnings.

1) firstly I am self-employed with a Ltd company of my own, through which I run my payrole every from from January 2019. My actual contract with an ageny to whome I was working ended in May 2019 and also transferred Dividents during this period. I am sure I have earned more than 18,600 in the last 10 months (which includes my monthly minimum pays + Dividents). My company was incorporated in Jan 2019, so to get my CT600 doc & Self assesment I have to wait until Jan 2020.

2) Now I have accepted a permanent job which starts in December, where my new employer is paying me more than 40k PA which is again more than 18,600 pounds PA.

Can you anyone please advise me how can I show earnings both Self-employment and Permanent to apply for Spouse Visa in January.

When I asked a friend who applied for his wife recently - he mentioned that he was asked to submit 6 months Payslips (he's also a Permanent employee)

Thanks in Advance.

You have managed to make this rather difficult for yourself I think.

"9.3.6. Income under Category F or Category G can be combined with income from salaried and
non-salaried employment, non-employment income and pension income in order to
meet the financial requirement. However, unlike with other Categories, these sources of
income must fall within the relevant financial year(s) in order to be included. Under
Category F or Category G, all sources of income must fall within the financial year(s)
relied on and must still be a source of income at the time of application.
"

"19. When calculating income from self-employment under paragraphs 12A and
13(e)… this paragraph applies:
(a) There must be evidence of ongoing self-employment, and (where income from
salaried employment is also relied upon or where paragraph 9(c) applies) ongoing
employment, at the date of application."

If you have earned at least £18,600 in the 12 months prior to applying, you could use this self-employment income combined with evidence of ongoing employment. Hopefully others will comment as well, but I think this will only work if you start your new permanent job within the full financial year you will be relying upon for your visa application.
I'm just a guy on the Internet who immigrated to the UK. My opinions are based on my experience and interpretation of the immigration rules and should not be considered legal or immigration advice; your mileage may vary.

Thank you 'geoeng' for your reply, I hope few others will also comment.

I just got a call from my new employer that I will be starting for a week in Dec 2019 before the holidays (I hope this will fall under a financial year Jan to Dec) which includes my Self-employment and a month's permanent employment.

Kind regards,
S
