I need your help!
My wife is Irish and I am non-EU citizenship,
I use to living in Northern Ireland i had a UK Visa.
We moved to Ireland in 2016 and i got my stamp-4.
I went to my local garda immigration officer couple months ago for renewal of stamp 4.
This is my first renewal i didn`t realize my wife have to be beside me!
Immigration officer asked me
Officer: Where is your wife?
Me: I said she is at the home.
Officer: She need to be here as well for renewal of your visa.
Me: when i made a apointment police officer told me bring your utility bills and passport. That`s why i came my own.
Officer: Where you working?
Me: I have a my own company, I am self employment.
Officer: What kind company you have?
Me: IT consultant and web developer.
Officer: Ok tell your wife i am here till 6 clock so she can come.
Me: She can`t !
Officer: Why?
Me: Because she working.
Officer: Where is she working?
Me: She is working Comunity Care and her work place in Northern Ireland.
Officer: Is your wife not living with you?
Me: She is living with me.
Officer: Where you living?
Me: I am living Donegal.
Officer: You said your wife is working North and you living South so I don`t get.
Me: I said my wife currently living 2 address thats why.
Officer: Well i can`t renew your visa without your wife, you need to make a another appointment and i am not gonna be here your next appointment my colleague might ask you extra documantation.
Officer: You have to proof your wife is living in R.Ireland, bring your marriage certificate and joint bills etc..
Me: That`s ok so can i get another appointment?
Officer: Ok, Your next appointment is 30 days later.
30 days later...
Me and my wife went to garda immigration officer.
Different Officer: I can see you was in here 1 months ago without your wife.
Me: Yes indeed,
Officer: Can you show me your utility bills and marriage certificate.
Me: I provide our marriage certificate, Electiricty bills (inc. my name and my wife name), my company bank statment, Internet bills (Only my name).
Officer ask my wife you are currently living 2 address? she said yes.
Officer I am sorry i can`t renew your stamp-4 , you need to fill RES-6 form and proof your wife is living R. Ireland.
I felt terrible after officer told me he can`t renew my stamp 4 .
I contacted the xxxxx olicitor about my current situation.
Solicitor told me my stamp-4 base of our marriage and you both still married living together it doesn`t matter your wife living 2 address (1. North , other is South) they should renew your visa.
Also solicitor told me we don`t need to fill RES 6 form we could explain by letter to Spouse of Irish National depertmant.

Note: House in Ireland belong to us(me and my wife) we bought the house 3 years ago.
The reason is my wife living in 2 address because kids are going school (N.Ireland) in there they don`t want to change they are school.
We are married 6 years but we are 8 years together. I am not biological father but kids are growed beside me they see me as a father.

I got today answer from Spouse of Irish National depertmant. They refuse renew my stamp 4 becuase you have failed to submit a completed RES 6 application form as instructed.
This office cannot accept your letter of application for permission to remain in the State as the spouse of Irish National due to the following:
1)Your Irish national spouse is not currently residing in the State.
2) You are not residing as part of a family unit in the State with your Irish national spouse.
-Completed Application Form
-Applicant's original current national passport
-Spouse's original current national passport
-Marriage Certificate
-Evidence of your residence in Ireland (examples available on application form) Documents listed at Section 8 of Application Form
-Two colour passport sized photographs of yourself, signed on the back by you.
-Two colour passport sized photographs of spouse/civil partner, signed on the back by your
spouse/civil partner.
-Detailed Relationship History
-Detailed Immigration History
Should you wish for your position in the State to be considered in line with your marriage to an Irish national, then it is open to you to re-submit an application on the relevant Spouse of an Irish National application form and forward same with the relevant information/documentation to the following address within 56 days from the date of this letter:
