Apply British Citizenship for my step daughter

Post by evanmaran » Sat Nov 16, 2019 12:26 pm

Hello Everyone,

I have been living in UK since 2008 with my family and got british citizenship for myself, my wife and my son.
I married my wife after she got separated from her first husband in 2004. My wife had 2 twin kids (boy and girl) from her previous relationship I have been taking care of them from they were 5 years. Now they are 25 years old. I put them in school education in India and when we came here in 2008, they were styding in boarding school under my siste'r responsibility. I was sending all fees and other stuffs.

After they finished school education, i brought them here for Bachelors degree. Because there is no one there in India to take of these kids, i thought will have the step daughter here and apply for settlement visa if there is any chance. Step son went back to India and again brought him here for Masters. He is doing his masters.
I am here to seek help for my step daughter.

I went to a solicitor and he suggested me to apply FLR on human rights basis and didnt get positive response. We didnt proceeded further and we just simply having her with us since 2017 after she finished her bachelors.

I just want to know how likely she can get settlement visa if myself or my wife can apply based on our citizenship. Please advice on this.

Thanks

If she is over 18, then she is considered an adult and cannot apply as your dependent for a settlement visa.

Why did you not sponsor them to the UK in 2008, which would have been substantially easier than trying to sort a mess like this out now when they are 25.

Unclear from your post if you applied for FLR(FP) and it was refused or.......?

When did her last visa expire??

Note that if she is an adult, she does NOT qualify for citizenship either as she needs 10 years legal stay to meet the good character requirements AND she needs to hold ILR for a minimum of 1 year after legal stay in a qualifying visa for 5 years OR 10 year long residence legal stay.

Thanks for your response.

It was my big mistake not sponsoring her in 2008.

Her legal visa expired in Dec 2017 and applied for FLR (HO) application in Nov 2017 through a solicitor. We got reply from Home Office that my application has been refused and
they have given option to appeal the decision but have to return to India. I am not confident going through that solicitor as he is not at reliable and not attending my calls.

My step daughter has always been under myself and my wifes shelter. As said there is no one in India and i dont have any house in India as well.

Since 2017 we didnt replied to Home Office and she is with us without proper visa. She is very depressed and atleast want to do higher studies. Because there is no certainity about her visa we dont know what to do.

Can you please suggest what is the best soution we can do to retain her with us at any cost?
