Marital status after applying for uk spouse visa using domestic violence route

Post by Buorems » Sun Dec 08, 2019 4:01 pm

I want to renew my spouse visa using domestic violence route, but i have the following questions to ask
* Do I need just a proof of domestic violence or a proof of domestic violence and proof of separation or divorce.
* If decision comes back in my favour, will my status still appears as married and bearing my spouse surname.
* Will the home office contact my spouse in relation to the claimed domestic violence.
* Will my spouse lose their rights to stay in the UK/British citizenship.
* Will home office accept my application without me going to a court.
* Is it permitted by the home office or the law to go back to my spouse after obtaining my renewal via domestic violence.
* Will my spouse have a criminal record as a result of me reporting to the home office.
* Will my spouse be sent to prison

I will be glad if someone with any idea could help.
Many thanks.

You can't extend your visa based on DV. It is ILR based on DV you apply for in form SET DV.
* Do I need just a proof of domestic violence or a proof of domestic violence and proof of separation or divorce.
You need proof of domestic violence, or police report, go report, help from a DV charity or social services etc etc. You don't need proof of divorce. Simply complete long the form and just saying your are victims of dv is not sufficient and it will likely be refused and you will lose your fee.
* If decision comes back in my favour, will my status still appears as married and bearing my spouse surname.
Anything you apply for will be issued in the same name as in your passport. You are married until the day the decree absolute is granted.
* Will the home office contact my spouse in relation to the claimed domestic violence.
Not sure, unlikely, but they do investigate your claim and supporting evidence to ensure it is a genuine claim.
* Will my spouse lose their rights to stay in the UK/British citizenship.
No,why would they??
* Will home office accept my application without me going to a court.
Why do believe you need to go to court??
* Is it permitted by the home office or the law to go back to my spouse after obtaining my renewal via domestic violence.
It might cast doubt on your claim of dv to obtain ilr and if proven, could result in revocation due to deception.
* Will my spouse have a criminal record as a result of me reporting to the home office.
The home office does lot prosecute people. That is up to the police and CPS.
* Will my spouse be sent to prison
You are misunderstanding the role of the home office here. They only deal with your immigration application!

When did you get your spouse visa and arrive in the UK?

If you are facing such and having much concern as outlined in your questions, ruminate on it well before going down the DVV route.
