Can Apply for FLR (FP) while fee waiver is been processed

I have a 9 yr old who will be 10 in August.
My wife and I are overstayers. We applied for fee waiver in order to put in our application but it is almost 2 months now.

We were adviced we need the fee waiver code before we can put in the application for FLR (FP) for the 7 years rule using our 9 yr old girl.

But the council has refused us section 17 , as we don't have a life application.So no support from council.

If you don't have fee waiver approval yet, you will have to pay for the application if you apply before receiving it.
