3 questions on spouse visa

1. i'll be living with my parents for 2 months after my wife is over in the UK. They are paying a mortgage and don't have land registry document as it's held by bank until mortgage is paid. What can we use to prove my wife and I can stay there?

2. Once I receive my sixth pay slip end of February, are we eligible to apply right away? I read something (don't know if it's accurate) that stated it had to be exactly six months from my first pay slip. My first pay slip that met the threshold was 30/09/19 and I will receive my sixth pay slip (that will meet the 1550 threshold) on 28/02/20. Would we then need to wait for the two days until we can apply?

3. Am I correct in saying once I receive my sixth pay slip on 28/02/20, we basically have to apply BEFORE I receive my next pay slip? (which will be on 31/03/20)

1. A copy of the property deed and/or a letter from the bank/mortgage statement would probably be sufficient to prove ownership of the property. You would also need a letter from your parents giving permission for you and your wife to live there as well as evidence the property will not be overcrowded.

2. In addition to 6 payslips showing income meeting the financial requirement, you must also have been employed with the same employer for at least 6 months.

3. The date of application must be within 28 days from the date of the last payslip being relied upon in the application.

In regards to number 1, what evidence could we provide to prove the property will not be overcrowded? It is a 3 bedroom house with just myself and two parents living here. My wife will be the 4th occupant.

I plan to submit six pay slips along with six bank statements showing the deposits of my salary. The statement will be printed off from my online banking but will be stamped with the heading of the bank.

Do I need to print off the statement for the entire month (about six pages for each month) or just the part showing the deposits of my salary?

In addition, my contract states a 16k salary but my pay slips (because of over tiem) are above the threshold. Can I submit my pay slips along with my job contract and they'll realise I've been doing overtime since my pay slips don't reflect what's written in my contract?

Job contract is not required.

You need an employer letter detailing your employment specifics, including overtime etc.

Spouse visa process and questions

Hello all,

Please offer some advice with my questions in regards to the spouse visa.

1. I work for a branch of the UK government doing admin work and have repeatedly asked for an employer letter, but am constantly refused this and am told to use one of our systems which has my contract details etc. My manager says they cannot provide one and is against policy. I tried getting one about one year ago and a different manager stated the same thing - that they don't provide these sort of letters and I need to refer to our online system.

- I mention where I work in case anybody answering has previous experience with this and can give me advice on how to proceed.

2. My fiancee and I will marrying in March and afterwards (in the same month) we plan to apply for our visa. Assuming I can get a letter from my employer, when should I ask them for the letter confirming my salary/position etc? I'm yet to receive my sixth and final pay slip so I'm unsure when to request it. Will this letter need to mention the overtime I have been doing?

March 1 to March 8 I'll be outside the UK and will need to apply for the visa before March 27 (28 days after I receive my last pay slip).

3. When should my parents get a letter from the bank showing their mortgage statement etc. to meet the accommodation requirement? Should this be in March or would now (in January) suffice? How up to date do these documents need to be?

4. My fiancee is from USA. Is there an option on the application form that we can select to say she doesn't need the English language test?

5. My contract is part-time and I am paid a salary less than the financial requirement of 18,600. I have been doing overtime for the past five months in order to meet the minimum requirement. When I submit my pay slips, will I need to explain the difference in what my job contract states my wages are, and what my payslips show?

6. Finally, when we apply do we upload the documents right away or does my wife apply then is able to upload the documents a few days later? Not sure how this works, apologies.
