Applying for working holiday maker if HSMP approval rejected

Post by whitehorse1111 » Sun Aug 17, 2008 8:13 pm

Hi,

I had an HSMP rejected due to not awarding points for income (I provided pay stubs signed and dated by my company but I explained that since my company doesn't have an official stamp available, I included a business card of the HR person that signed them for verificaiton) Instead of verifying they said I needed independent and verifyable evidence that my company didn't have a stamp :(

My wife and I may not want to wait too much longer for the appeal to go through that we filed - does anyone know whether

a) we could apply for working holiday maker visa while the appeal is outstanding (would it pose a problem)

b) if we withdraw the appeal will we have a better chance?

c) we really changed our plans and now only want to travel throughout UK for a year and work to support ourselves since the HSMP will likely not go through and we don't want to pay / wait another 6 months to get approval.

How do you convince the UK office in your country of your intentions (not just to work?)

d) On the working holiday maker application form it asks if you've ever made an "Application to Remain" in the UK. Does an initial HSMP approval application qualify as that? Or is it something different?

I thought application to remain means an application to stay once you were already admitted to the UK but I want to disclose the HSMP application if it includes it.

thanks so much for anyone's suggestions on these 4 points!

John

Hi John,

Im sorry that I cant answer your query but let me say that your HSMP outcome sounds very disappointing. My partner and I have been waiting three months for our apps to be processed and will be heartbroken if, in a month or two, they are rejected as yours were.

Would you please tell me what evidence you sent to prove your previous earnings? Other members will want this information in assessing your chances of appealing or reviewing the decision.

We provided a full year of pay stubs, unfortunately they were only available to print on regular paper but from our official payroll company's website.

Stamps are uncommon in Canada and we thought it would be acceptable to explain that our company didn't have a stamp along with contact information if it needed to be verified.

The other piece of information was a tax form from my company, an official one but on plain paper - and was rejected as not an original even though that's what is provided and is official for filing income taxes in Canada. Similarly this was signed and dated and the same business card attached but we were rejected.

Both the pay stubs and tax form were official just on plain paper.

---

I think we should have provided 4-5 pieces of evidence but even then if we had included bank statements our bank is online only so bank statements would hvae been rejected for the same reason. I would have needed in addition a letter from the bank but we're not even sure how that would confirm all online printed statements were correct.

We could have also included a letter from my HR department stating our salary but it specifically said that's only acceptable as evidence if a tax form and pay stubs aren't available so we (unfortunately) didn't include it.

Does anyone have an idea about the other questions?
