Tier 2 dependant to Tier 2 general for ILR

Hi,

I am working in UK on Tier 2 since February 2016 in an automotive industry.My T2 visa is valid until January 2021.I already spent 4.5 years and will be eligible to apply for ILR on 26th December 2020. Unfortunately I was laid off from my job. My last working day will be August 21 including my notice period. . I was trying for new sponsor for last two months. but there is no success

My wife is holding Tier 2 dependant visa and she also spent 4.5 years in UK. She is a software test analyst. if she find a sponsor and switch to Tier 2 general from Tier 2 dependant. Are we still eligible to apply for ILR in December 2020? or Do we need to spend another 5 years to apply for ILR?

No.

Yes.

You cannot combine time spent as a tier 2 main visa holder with time spent as a PBS Dependent to make up 5 years for ILR. You need 5 years on tier 2 or 5 years on PBS Dependent.
