ILR for Spouse

Hi,

I hope someone can help me with the following queries. I am eligible for ILR via 10 year long residence route in September,2020. However my wife has spent only 7.5 years in the UK. Both my self and my wife has Tier 2 visa till March, 2023.

1. Can she apply for ILR with me in September?
2. If she cannot apply for ILR what visa should she apply? Does she have few different options?
3. If she has to apply for a different visa, can she apply with me? or does she have to apply after I obtain ILR. Are their time limitations on this?

1. Not under Long residence.
2. FLR(M).

Thanks for your reply. Can you please clarify them a bit

1. UKVI online application states family route, is this same as FLR(M)? There is no specific online application for FLR(M) like Tier 2 or Tier 4?

2. Once I obtain my ILR, how quickly does she need to apply for FLR(M). Is there a time limit?

Can I know the exact validity period of the family visa. I've read its 2.5 years (or 30 months), elsewhere on the internet I've read its 33 months.

It is usually for total of 33 months for the initial spouse visa. For what purpose is your clarification?

I am going to apply for ILR (Long Residence) next month. My wife will need to apply for family visa as she still have not completed 10 years. She will apply from UK and switch to Family visa from Tier 2. She entered UK in 2013 as a Tier 4 dependant, and switched to Tier 2 dependant in 2018.

A spouse visa applied for within the UK is for 2.5 years (30 months).

A spouse visa applied for from outside the UK is for 33 months.

Her family visa can even be applied alongside with your application for ILR by attaching a covering letter requesting to not process it until you obtain success. By doing so you can avail to pay lesser IHS which is penciled in to be ballooned from 1st October.

NARIC Soft Copy

Hi,

NARIC only issues a soft copy (PDF format) due to Covid. I am planning to use it for a family visa application, applying within UK. Does the UKVI accept the soft copy? Is there anyone here whose visa got accepted or rejected after submitting a NARIC Certificate Soft Copy?

I've read people mentioning that ILR clock resets to zero when moving to family visa from Tier 2 dependent, and would need to stay for another 5 years.I'm not sure how this effect when planning to apply for ILR via long residency route. Yes, if she meets all the requirements to apply based on long residence, ie. absence limits etc.

Any posts that talks about ILR clock resetting also clearly states it is the 5 year ILR clock that resets and not the 10 year ILR route, where all visas count.
