Tier 2 Visa Extension - Days of validity on new BRPs for expired CoS

Hello all,

I am in a strange situation due to COVID-19 closures.

I applied for a Tier 2 visa extension on 6 June 2020. The CoS sponsored by my employer for this extension was valid up to 31 July 2020.

Due to COVID-19 closures, my application is still under processing although my CoS end date (31 July 2020) has now passed. My conditions of stay would remain the same since I have an ongoing application although the CoS end date has now passed.

I received an invitation for using the IDV app on 5 September 2020. I had opted in for using the IDV app and submitted my facial images and live video on 6 September 2020.

Now I have two questions:

1. What is the expected processing time these days from the submission of live feed video on IDV to receiving a decision email from the home office, and receipt of new BRP?

MORE IMPORTANTLY,

2. How many days would I be allowed to stay from the date they would process the application?
Earlier, this used to be 2 weeks on top of the end date of CoS. Now given my CoS has already expired (on 31 July 2020), would it still be 15 days from the date they would print the new BRP or has it changed?

Any help from anyone would be greatly appreciated. I now have flights to book, but the above two questions just leave me in an uncertain and nervous state.

As long as you applied for your extension application in time, i.e. before your Tier 2 expired & with valid CoS, then there's nothing to worry.

1. Check timeline thread to get an estimated time

2. Not exactly sure what's your concern or query here, but you won't be termed as overstayer while application is pending with UKVI. The extra days on top of your normal visa is covered on your BRP end date.
My advice is based on personal research/experience, so pls check relevant UKVI sources.

Let me clarify my query.

I am interested in knowing the number of days I would get from the date the new BRP gets printed, given my COS already expired:

My CoS Exprired on 31 July 2020 for this ongoing application. Let 's say they process my application and print the new BRP on 15 September 2020, then my question is what would the end date on my new BRP be? Would it be 30 September 2020 (2 weeks)? or 14 October 2020 (1 month)? Or 22 September 2020 (7 days) since my CoS expired long time ago?

How long your visa is granted for depends on how long the visa is you applied for based on the length stated in the UCoS.

Thanks for your reply. The CoS was issued from 1 June 2020 to 31 July 2020 (so length is 2 months) and it expired on 31 July 2020.

Why only a short CoS length?? You will likely not get a visa extension if you did not apply for a 1, 2 or 3 year visa with the length stated in the CoS.

No I disagree. I don't think there is a minimum duration. I applied previously for 3 month extension successfully prior to this application.
