Outside UK in India for more than 6 months due to Maternity

Post by gibraltor999 » Fri Jan 22, 2021 2:56 pm

Hi,

I am planning to go to India for my Maternity leave and would be there for more than 6 months (around 7 months).

I know there will be an impact of this while I apply for ILR, but apart from that is it ok from the immigration side for me to enter the UK after 6 months.

Can someone please confirm this soon. I would highly appreciate.

Yes, if your visa is still valid. Else, you will need to apply for a dependent visa again before entering the UK.
You cannot extend your visa outside the UK

Thank you for your prompt response. So my visa is valid until 15-March 2023 and I am the main applicant of Genereal Tier 2 Visa. My kid whose visa is also valid until 15-March 2023 will be travelling along with me to India.

So can you please confirm that after 7 months, there should not be any problem for me, my daughter and new born to come back to UK.

There shouldn't be any issue to enter the UK again.
Obviously, the newborn will need to apply for an entry clearance visa. I hope you are aware of the fact that children born outside UK are not entitled to apply for British citizenship when one of the parent obtains ILR.
Yourself and your kids may qualify for ILR at the same time when you satisfy the requirements
