Domestic abuse and removal proceedings

Post by sarah1902 » Wed Feb 24, 2021 11:42 pm

Hi there,

I was wondering if a domestic abuse victim is subject to removal proceedings because their abuser is (i.e. they are a dependent on their abuser's Visa and that Visa holder is subject to removal proceedings) does the victim have the chance to suspend these proceedings to apply for autonomous status i.e. under the domestic violence rule? Is this done by access to DDVC or by injunction, what are the options?

The usual case type seen is where the visa holder is a spouse / partner of a UK serried person and they would seek to remain under the domestic abuse route.

I have not come across a position where the abused and the abuser are visa holders, one dependent on the other. The rational instinct would be to say it would be possible that the abused could seek to remain in the UK, There is nothing that I can see that would prevent a domestic abuse claim in the info below.
