Certificate of Sponsorship for Fixed Term Contract - Urgent Please

Post by MeriemL » Mon Nov 01, 2021 2:36 pm

Hello,

This is a bit urgent and I would be very grateful for your help, please.

My employer has agreed to sponsor me and is in the process of applying for a CoS.

I was told that they have applied for CoS 18 days ago, but I have just received a message from HR asking for the salary I would be getting and the length of the contract to see whether I can be sponsored and they will then apply for the CoS.

My contract was supposed to be from September 2021 to August 2022 (with the option to extend, but I won't know for sure until May 2022). I started working with them in September and they should have applied for CoS then, but they kept putting it off because my Tier 4 DES Visa was still valid. Now it seems too late because my visa expires in 2 weeks.

Can CoS be issued for fixed term contract until August 2022?

I am completely lost and don't know what to do if they don't apply for CoS on the basis of the length of the contract.

If they are registered sponsors and have an undefined CoS allocation available the CoS can be assigned to you immediately. If they don't have an available CoS allocation they can apply for one through the priority service - 5 working days turn round time. cost £200.

These questions are for the management, not for you.

the work end date in the CoS can indeed be Aug 22

Thank you SO much for your reply. They are a registered sponsor, but I assume they don't have any allocations (I asked them twice if they had any and they didn't reply) and I think they are using a solicitor. I will email them again and ask them to use the priority service.

I am not sure why they asked me those questions directly, I too thought management and HR had the answers, but they emailed me and said "we need you to provide the following information before we can apply for CoS".
I am worried now because even the contract has not been prepared yet and when I asked for it they said I would not need it for the visa application.

So it won't be an issue if the CoS and Skilled Worker Visa application is for less than a year?

Thank you.
