Family visa extension

Post by gaurav659 » Wed Nov 03, 2021 12:53 am

Dear experts,

I was on tier 2 general work visa, my family joined me in UK after two years and got tier 2 general dependent visa. I have got ILR in March 2021, My family is still holding existing dependent visa which is expiring in Jan 2022. She will complete around 4 years in UK on that visa. She would need 1 more year to file ILR.

What type of application should I initiate so that she can claim last 4 years as well. I have two options
1. Can I extend her existing tier 2 general dependent visa? Is it allowed, as I got ILR recently ?
2. File new visa under ILR dependent spouse category. Can U claim her 4 years for ILR application?

Thanks
Gaurav

1. Yes.
2. No.

Your partner and children.

Expect a three years extension. But may apply for ILR when eligible sooner.

Dear Experts,

Thank you so much for valuable information you have provided before. I have started completing my Spouse extension request. Interestingly, I have got below information which gave me confidence that I am moving to right direct.

"Which Visa or permission to stay has Mr GXXXX Gxxx Applied for or been granted?
Choose the service that Mr. Gxxxx Gxxx Most recently applied for, even if their application is still being processed. if the main Applicant has been granted indefinite leave to remain or British Citizenship, You should choose the route under which they were granted leave before."

I have selected this option as I was having this visa route before my ILR : Tier 2 (General) leave to remain.

I have completed application and moved towards paying IHS surcharge. And here I have seen very different options

Under the category "The person you're joining or remaining with" (These are about my details who is holding ILR, I haven't seen ILR option in below list, even I haven't seen Tier 2(General) option which was in main application. )
Question1: Which option is relevant for me from below list? My selection would be skilled worker which is very closed to Tier 2 general. But I need confirmation..!!!

Visa Route options are given below
  • Code: Select all

    Dependent
    Discretionary Leave
    Further Leave to remain- FLR
Further Leave to remain Human rights and other claims- FLR(HRO)
Further Leave to remain immegration rules- FLR(IR)
Further Leave to remain other - FRL(o)
    Global talent
    Graduate
    Graduate dependent
    Hongcong British national Overseas
    Innovator
    International Sportsperson
    Intra-Company route
    PBS dependent (Global talent)
    PBS dependent ( Tier 1, 2 and 5)
    Skilled worker
    Start-up
    Student
    Temporary work
    Tier1
    Tier 2
    Tier 2 PBS dependent
    Tier 4
    Tier 5
Visa Type: Selection list is based on Above list

Question 2: I am holding ILR at present. In IHS form, They are asking for visa expiry. My Current ILR visa expiry date is mentioned as 31-12-2024. Do I need to use this date or Need to manipulate expiry date to a point that can have approx 3 year extension ? Do Providing a manipulated via expiry date have any impact on application?

Question 3: I have tried giving my ILR expiry date in IHS form, which has calculated an amount which is equivalent to 3.5 years of extension. Is this valid?

Thank you Vinny for quick response !!!,

I am not clear on second response that you recommend for 3 years extensions. this means I have to put Visa expiry from Today + 3 years in IHS form, but validity of my ILR visa is in Dec 2024 which is about 3 years 2 months.

Am I allowed to manipulated ILR Visa expiry date in IHS form?

What is your recommendations Option 1 or Option 2

Options 1. Put ILR Last validity as visa expiry in IHS form which is Dec 2024--> IHS form is calculating 3 years and 2 months from today and applying an IHS charge for 3.5 years which is 624* 3.5 = 2184

Option 2. Or if I manipulate visa expiry date till 3 years from today which is Oct 2024 . IHS will calculate charge 624*3= 1872
