Which visa should I apply for my child born outside UK

Post by Amala » Sat Jan 29, 2022 9:55 am

Hi,

Me and my husband both are UK ILR holders with Indian passport. I came down to India last year to do IVF and fell pregnant. Due to complications I delivered my baby in India. Now I want to bring my child to UK in the month of June or July. Is my child eligible to apply for ILR from India? If not, what visa should I apply for my child...is it child dependent visa? Can someone leave me a link to the online visa application?
Also do I need to pay Immigration health surcharge for my child along with the visa application?
Since I am on maternity leave can I use my husband's payslips to show as financial evidence if needed?

Thanks,
Ammu.

(Apply separately

Which form you need to fill in depends on whether your parent has leave to enter or remain in the UK on a 5 or 10-year route to settlement as the partner of:

a British or Irish citizen
a person with indefinite leave to remain
a person settled in the UK - for example, they have indefinite leave to remain, settled status or proof of permanent residence
a person from the EU, Switzerland, Norway, Iceland or Liechtenstein who has pre-settled status - they must have started living in the UK before 1 January 2021
a person with a Turkish Businessperson visa or Turkish Worker visa
a person with refugee status or humanitarian protection
If they do, you must fill in the Appendix FM online form.

If they do not, you must fill in both:

the online application form
the Appendix 1 paper form

Non-British child of a parent granted or currently applying for permission to enter and stay in the UK, as the parent of a child who is a British citizen, settled in the UK, or in the UK with pre-settled status under the EU Settlement Scheme.)

If my understanding is right I must fill in the online application form plus the Appendix 1 paper form and not the Appendix FM Child form since both parents already have UK ILR?

Calculate your immigration health surcharge
You can use this calculator to work out if you need to pay the immigration health surcharge, and how much you need to pay.

Are you...
Applying alone
Coming to the UK with dependants
Applying to join somebody (a main applicant) in the UK.
Which option should I select from above:
Is this the right one:
Applying alone- Visa route is Settlement- Child or other dependent of settled person.
Then the IHS comes to £0. Is it right?
