Dependent visa extension after primary applicant gets ILR

Post by Ran2404 » Fri Apr 28, 2023 10:19 pm

I have a query about the extension of my dependent visa.
My partner, the primary applicant was under a Tier 2 skilled worker visa from Jan 2018 to Jan 2023 and got ILR by Feb 2023.
I got my skilled worker dependent visa on June 2022 which is due to expire next month.
Which route should I be applying my dependent visa extension; family route or can I extend my skilled worker visa even though the primary applicant has ILR now, also considering the factor that family route costs around £1000 for application in addition to IHS whereas skilled worker dependent costs approx £300.

How did your partner get ILR? Was that based on five years in the UK under Skilled Worker visa or 10 years on Long Residence?

But what will happen after this 3 year when i am re-applying again for visa extension- by then my partner would already be a British passport holder, will i be able to extend the skilled worker dependent visa further till i finish 5 years in UK/apply for ILR?

Doesn't matter if they're British - they got ILR via this route when you were their dependent.

SW 39.1. The applicant must be the partner or child of a person (P) where one of the following applies:
(a) P is, at the same time, being granted settlement as a Skilled Worker; or
(b) P is settled in the UK or has become a British citizen, providing P had permission as a Skilled Worker when they settled and the applicant either:
i) had permission as P’s partner or child at that time;
