ILR eligibility - break in employment for 12 months during pandemic

Post by raj_03 » Fri Jul 07, 2023 12:49 pm

Hello everyone,

I need some advice to check if I am am eligible to apply for ILR this year.

I have been on work visa since Jan 2018 and I decided to change my job in April 2020. I got the new visa but they didn't provide me a start date due to the whole pandemic situation. I found another job in April 2021 and started working for them till date.

Since I had a break of 12 months without job while I was in the country under a sponsor during pandemic, I was wondering if this effects my ILR application?

Thanks

I do not think this would be an issue for ILR

Hi Zimba,

Thanks for the reply. I was a bit confused on the eligibility criteria description "You must: have lived and worked in the UK for 5 years"

I can confirm that I lived in the UK for 5 years but not worked for a year. For some reason if the caseworker decide to ask for any Proof of employment/Payslip during that period I will be in trouble.

Thanks

The ILR criteria is holding a valid visa for 5 years. Refusals will be based on the rules not what a caseworker feels

You will not be asked for any documents from a previous job :!:

Which category of leave do you have? Note that they had removed a continuous employment requirement for some categories.
