Where was she born? ok let me try to explain,My Mother was born in Zimbabwe, she came to the uk in 1974 as a trainee midwife with a british passsport as british subject.While she was training,she met my father,He was a citizen of Botswana,They got married in 1979 in Botswana,My moms british passport expired in 1982 so she gained Botswana citizenship through marriage and was issued with a Botswana passport.She never once surrendered her citizenship,2 years later i was born but sadly they divorced,She continued with her botswana citizenship because she had decided to live there and raise me there.the divorce was final in 1992 through the Botswana courts,fast forward to 2002.My mom applied for a job in the UK and the work permit was granted.After 5 years she was granted ILR.We just found her old british passport now,she thought she had lost it all these years!!It has a reference numbers and everything.My question is can she claim back her british citizenship as a british subject even though she never gave it up 25 years ago and do i qualify to be a british citizen by descent.

Southern Rhodesia was a colony until 1980, however from 1949 it was treated as a "country" by Britain for nationality purposes.SUB-ZERO wrote:Hi

This is quite curious. Based on the facts given, I cannot see how she was legally given a British passport.
In 1974, a "British subject" without citizenship could only hold this status from a tie with pre-1949 British India or Southern Ireland.
And I really see no basis on which she could have been a Citizen of the United Kingdom and Colonies (CUKC) if both she and her parents were born in Southern Rhodesia.
Where were her grandparents born and did she ever hold a Southern Rhodesia passport? What passport did she use to travel to South Africa?
CUKC was conferred on some people from Southern Rhodesia in 1964 when the Federation of Rhodesia and Nyasaland was dissolved, but only if they did not become Southern Rhodesia citizens again on 1.1.64. I don't have the relevant legislation but I would have thought that if she was born in Southern Rhodesia then this would not apply. And even then it wouldn't explain the lack of CUKC references on the British passport.
As far as her ILR goes, normally it is lost by absence from the U.K. except that in her case, it may still be valid:
- if she was a CUKC (which she doesn't appear to be) then if she had lived for 5+ years in the U.K. before 1983 she would have become a British citizen on 1.1.1983; and
- If she really is a British subject, her ILR might still be valid.
Her ILR wouldn't make you a British citizen now, because you were born outside the United Kingdom.
Is she now a Botswana citizen?
