Visit Visa Rejected - Sponsor not subsisting (UPDATE)

Post by IPFri13 » Wed Oct 11, 2023 2:02 am

Hi All,
I just wanted to post an update to a post I raised previously about a UK Visit Visa Rejection (Philippine visitor).

general-uk-immigration-forum/visit-visa ... 35527.html

I raised a complaint regarding the Rejection.
I challenged that the ECO had suggested 'cohabitation' was expected as a prerequisite for Sponsorship, and other items raised in the initial post (link above).

Initial Application end Jan '23.
Initial Rejection mid Feb '23.
First Complaint (by email) March '23 (ignored).
Second Complaint (by email) April '23 (ignored again).
Escalated via Sponsor's MP (who contacted the relevant UKVI team).
Resolution circa 3-4 weeks later - with visit visa being granted.

Long, long, process... but ultimately I think the correct decision was made.
Visa used to enter/leave UK Aug to Sept.

Good challenge. Similar to Case study 4 – Bangkok:
The applicant:
  • submitted a General Visitor application on 13 November 2009, to visit their partner in the UK, with supporting documents including i) evidence of their sponsor’s financial circumstances; ii) a letter from their sponsor describing their relationship;
  • was refused entry clearance on 18 November 2009 with one of the grounds for refusal cited as failure to demonstrate a subsisting relationship with their sponsor.
Chief Inspector’s comments:
  • There is no requirement in the Immigration Rules for General Visitors to demonstrate a
    subsisting relationship with their sponsor.
