Apply for FLR before NHS surcharge increase

Apply for FLR before NHS surcharge increase

My wife is currently living and working in the UK on a Partner (Family) Visa. Her current Residence Permit is due to expire on 16/03/2024 having been issued on 09/06/2021. She first entered the UK on 02/08/2021.

With the NHS surcharge due to increase on 16/01/2024 my wife will have been in the country for 2 years and 6 months on 01/02/2024 which is after the expected surcharge increase date. I have read that you can apply for FLR upto 28 days before the applicant has been in for country for 2 years and 6 months, if this is true (which I'm not sure) this would allow us to apply from 4th January for FLR and therefore avoid the surcharge increase.

My question is am I right in thinking that we can safely apply for FLR from 04/01/2024 and fall within the correct timeframe for the application? The last thing we want is for her FLR visa to run out before she is able to apply for ILR, so would this be cutting it too fine if it's even possible?

Application can be made 28days before completing 30months in UK on spouse visa, so yes this can be done.
