Unbelievable.PSW REJECTED

A friend of mine had his PSW rejected. He supplied a bank statement for three months, stamped,signed, with a letter of authenticity that carries his name, address and his account details from his bank.

His statement was for the period 2nd of september to 1st of december .

His opening balance was £705 for september 2nd and he put £800 that same day in his account so he had £1505 at the end of the day with his balance not going below £800 at any point till 1st of december closing at £1700

He got refused because his opening balance for 2nd of september was £705 .This is not a day below we are talking about. Just a couple of hours.

Dude got fed up with the system, refused to appeal and has left the UK. Good for him cos he already has a better job offer in his country. The system is just so Bureaucratic.

PBS is relatively simple and clear - if the balance falls below £800 it kills the application. No if or buts, there is no discretion. That is not bureaucratic that is an open and transparent system.

Why could the individual not have waited for one more day? That is not the fault of the system but the fault of the applicant. It is their role to manage their application..... not UKBA to manage it for them.

As foir the case quoted - naughty naughty Vinny - spouse visa is not PBS!!!

Yes. It is a PBS system and Discretion is not allowed. But common sense should prevail;Unless common sense too is not allowed in a PBS

How many british graduates can maintain £800 pounds for three months without it going below ?This is an issue of having £705 in the morning and Putting £800 that same morning of september 2nd and it never went below till december 1.

He had to pay outstanding bills he had held off in December 2nd including rent, Gas, Electricity and all that. I am happy he left the country and did not appeal. I am european and even i find the british system a big mess and unfair . It is just so sad.

Yes. You are quite right.

Although open and transparent, this refusal is an adverse consequence of a "tick box approach" by decision-makers.

follow check box approach doesn't mean not to use common sense. this really is not fair

Can't have it both ways - tick box with discretion..... can't happen. If this case had gone to court it would have been dismissed as it could not meet the rule. It is not 3 calendar months minus a day. The line has to maintained as the next appeal wins on minus 2 days, then 3 days etc.

The AIT is upholding the PBS decisions that do not meet the rules. Where the rules have been met but the caseworkers have misunderstood the information supplied the courts are allowing the appeals. The cases take 20 - 30 minutes to hear because it is that cut & dried.
Never said the system is perfect :D
