ILR Submission Due - Tier 1 200K Route

Post by Tortoise » Fri Aug 30, 2024 10:57 am

Morning all,
Below is my scenario:

Tier 1 team (2 members)
Initial visa granted in July 2019
Travelled to UK in August 2019 and setup business.
Extension granted in Jan 2023.

Team 1:
Qualifying period ok, no outside UK travel.
Spouse is working in private sector.
Two kids, but both turned 18 after we got the extension in January last year.

Team 2:
Qualifying period for main applicant and kids is fine.
Spouse travelled a lot due to personal business (this is not our main business)
Stuck outside UK for the initial 1.5 years due to covid, so the qualifying period for ILR is not complete. Short of 1.5 years in total 5 years.

Query:
1) Team 1 is good to go and apply for ILR. Can they do it without the other team? Since the period for spouse of the other team is not completed?
2) Can both team use different solicitors to process the case?
3) What options do we have for team 2 spouse whose period is not complete for ILR application?
4) Does anyone has specific documents required list for ILR? Do we need to provide the documents we provided at the time of extension?
5) The kids turned 18+, where are they standing? Do we need to worry about them? We can provide documents that they are living with us? Any idea which documents make sense to attach with the application? Both kids have passed life in UK and B1.
6) Which documents are needed for cohabitation for team 1 couple?

I hope i have clearly stated the issue, but please advise if you need any further information here.

Best regards,
TT :D

1,2. This was a common misconception about teams under the Tier 1E route. Team members are simply allowed to claim the same investment and job creation evidence in their business to support their applications individually. Team members still will have to apply SEPARATELY and qualify ON THEIR OWN. Your visa or ILR applications are NOT linked or connected as they will be decided on their own rights. Do not get confused

3. How many months are they short in order to qualify?

4. Almost the same as your extension plus ILR-specific evidence like life in the UK and the English language.
Have you read the official guide ???
https://assets.publishing.service.gov.u ... _10.21.pdf

5. No issues. They can be added to the ILR application if both parents are applying together. Them turning 18 is not an issue as they were granted dependant visas as children initially.

6. All you need to know about cohabitation evidence

Thank you Zimba.

They were out for the first 6 months after they did the entry and collected the BRP, and later whole year of Covid. Came back early 2021. If they wait till Jan 2025, they will complete 4 years qualification period.

They should be able to extend as PBS dependants, that route will not close

Hi members,
I am gathering my documents for application. A few question for bank statements:

1 - Do we need the bank statements signed by the bank or we can use the online version as well?
2 - I have two bank accounts, do i need to submit both bank statements or the one that has the employees salary movement?
3 - Shall i submit only 12/13 months bank statement just to cover the employees salary transfers or it has to be from the date of extension?

Regards
TT
