WP(laid off) to Tier1

Hi there,

I am a work permit holder.
I am just laid off by my employer and have only 8 week legal residence in UK.
my question is:
1. can I legally stay in UK after I send the tier1 application until a decision is made?
2. If my application is refused, how long can I legally stay in UK to prepare for re-application?
