British Citizenship application & evidence

Post by aleksandra914 » Fri Oct 18, 2024 11:05 am

Hi everyone, I'm going to be applying for the British Citizenship soon and wanted to double check if evidence I plan to provide is sufficient & some of the application questions.

For context, I have a settled status under EUSS since 2019 and I'll be applying as a spouse of a British citizen (married in 2023). The documents I can provide are:

- Current EU passport
- Husband's British passport (I understand that all pages of my EU passport should be scanned, should I also scan all pages of husband's British passport?)
- Degree certificate from a UK university
- Marriage certificate
- Referee declarations (both referees are British & of professional standing (chartered accountants)) - do they have to be dated before or after I the date I send the application?
- Driving licence and EUSS letter which confirms settled status as extra documents.

To prove residency I can provide:
- A letter from work confirming employment, including UK office location, for the entire 3-year qualifying period - who should be the addressee of this letter (Home Office, UK Visas and Immigration etc.? ) Does it matter what is the date of a letter, e.g. can it be dated a week before I send my application?
- Mortgage statements covering the whole 3-year period
- P60s for all three years (to Apr-24)
- Council tax bill letters for all 3 years

Are these documents sufficient to prove residency? Mortgage docs and council tax letters are in joint names, is that okay?

Also with regards to passports, can you please confirm that physical passports don't have to be sent and scans of original documents are required instead?

There are also a few questions on the application which I'm unsure about so any advice would be appreciated:

Have you provided evidence of your English language ability in a previous application? / Did you meet the knowledge of English requirement as part of an IRL application made on or after 28/10/13? - Should I respond No to these as I don't recall having to provide them as part of EUSS application?

Are you able to provide a BRP card with this application? / Do you have a BP from a previous stay in the UK? - I'm assuming this is a no given settled status is only evidenced online?

Have you made any previous UK immigration applications in the UK or abroad?
- Does EUSS count towards it and therefore it is a Yes?

Apologies for a lengthy post but any advice would be greatly appreciated!

Note the naturalisation application requires a minimum number of documents, unless the scenario is difficult. Naturalisation isn't an immigration application and has it's own rules and law.

- Current EU passport
- Husband's British passport (I understand that all pages of my EU passport should be scanned, should I also scan all pages of husband's British passport?) No - just for husband's passport personal details page(s)
- Degree certificate from a UK university
- Marriage certificate
- Referee declarations (both referees are British & of professional standing (chartered accountants)) - do they have to be dated before or after I the date I send the application? Before or after is ok.
- Driving licence and EUSS letter which confirms settled status as extra documents. DL not required! Letter is fine

I did the same for 5 years residency - "to whom it may concern" is sufficient - this was my only residency document I submitted!
- Mortgage statements covering the whole 3-year period not required
- P60s for all three years (to Apr-24) not required
- Council tax bill letters for all 3 years not required

Are these documents sufficient to prove residency? Mortgage docs and council tax letters are in joint names, is that okay? not required - employer letter will be sufficient.

Also with regards to passports, can you please confirm that physical passports don't have to be sent and scans of original documents are required instead? No physical documents are required - just scan and upload

There are also a few questions on the application which I'm unsure about so any advice would be appreciated:

Correct

Are you able to provide a BRP card with this application? / Do you have a BP from a previous stay in the UK? - I'm assuming this is a no given settled status is only evidenced online? Correct

Have you made any previous UK immigration applications in the UK or abroad?

Correct.

Thank you so much, this is really helpful!

One other question I have is around comprehensive sickness insurance rules which used to be in place in relation to students & self-sufficient individuals. In the naturalisation booklet dated July 2024, the guidance states:

If you are an EEA national, supplying evidence of your settled status under the EU
Settlement Scheme (EUSS) will also normally meet this [lawful residence] requirement. That also means you
will not need to send evidence of what you were doing in the UK prior to being granted
settled status.
This includes people who did not hold comprehensive sickness insurance under the
EEA regulations whilst either a student or a self-sufficient person. You can now meet the
lawful residence requirement simply by showing you have been granted settled status
under the EUSS. You also no longer need to explain why you did not hold comprehensive
sickness insurance

Have people affected experienced any issues with their application? The guidance sounds as if as long as one has a settled status, Home Office assumes they were a lawful resident prior to that and do not care whether they had CSI or not. I spent the first few years in the UK as a student and was affected by this, however this was long before the naturalisation qualifying period so is it safe to assume this will not be an issue?

CSI is no longer an issue.
You don’t need to worry or prove anything about it.
You will notice there’s no question about it in the application.

If your husband naturalised as British provide also his naturalisation certificate - other than that you will be ok.
All advice comes from personal research and experience and should not be regarded as professional opinion.
