Spouse visa application with history of alleged deception

Post by Newbie36 » Sat Oct 26, 2024 12:56 am

Good morning,

My husband and I are preparing to apply for his spouse visa. I'm British and he lives in Africa.

He initially submitted a visitors application in 2009 with the name John which was refused due to not meeting requirements.

He then submitted a further application in 2016 with the name Johnny which was refused due to not meeting requirements. In the second refusal, the case worker pointed out that he has previously used a different name. He also accidentally answered no to the question if he has previously been refused a visa. The case worker notes that any future applications are likely to be refused under 320.

My question is how do we address this in the spouse visa application. The answer no to any previous application was a stupid mistake on his part. His name is Johnny but when he applied for the initial passport his dad who submitted the application for him wrote John and he didn't think it was a big deal. He later changed it when he applied to renew his passport.

Your help would be greatly appreciated.

I guess you'll have to apply to find out the answers you seek. Deceptions changing names or DOB are taken very seriously. Hard to know if spouse visas make his sins to be forgiven.

I guess he just has to come clean and explain about the oversight.

Guess he has a 10 year ban from 2016?
No sin in failing, you just have to try and try again!

We almost have the same issue at hand. I had invited my sister several times between the year 2005 to 2007 with a different name. In the year 2007 she decided to use another names because our passport wasn't biometric passport but unknowingly for her she thumb printed submitting her application. Unfortunately, her application was denied. She now got married to uk citizen in 2016 and submitted an application on her real name same year. The application was rejected as well and pointed out that she had already use a different name in 2007. She want to submit a fresh application next year and to be real open in admissions to all her messed up. 50-50

There is provision in all application for this. Simply fill there areas where it was asked if applicant has had or been known by any other name or names and state reason why.

It only becomes complicated with knowingly deception.
