Return travel from India to UK after layoff

Post by ukmallu12 » Fri Dec 06, 2024 1:48 am

Hello guys

Need some information on the below scenario.

I was made redundant on a Skilled worker visa and my LWD was on November 20. Being on garden leave and not able to secure a job in the UK because of the dire market, I decided to go back to India to join somewhere there. I have some offers in India and I am currently back in India. I have a final round of interview with a UK based company next Wednesday and if they make an offer, would I be able to travel back based on my previous visa, which is valid till 2026.

I checked with my employer and they said they've already informed Home Office about the visa situation on last Friday, 29th November. Since I am not in the UK, would the immediately cancel my visa?

So my questions are:
1. If I get an offer, should I travel immediately if the eVisa status for previous employer is still valid in the gov portal? Would I be stopped at the immigration at Airport if I travel
2. If I get curtailment email before that, Can I apply from India again? If so would it reset my ILR clock?

Kindly advise, thanks in advance

1. Technically you can't and can be stopped at the border as your permission is no longer valid due to you not meeting the visa conditions which is working for your sponsor.
2. You have 14 days to apply from the date your permission expired otherwise the clock is reset.
3. When you are outside the UK curtailment takes effect immediately.

You can still try to come back though be prepared to be asked at who are you working for....
Maybe if you tell your story and your visa is NOT curtailed yet you will be allowed in on your skilled worker permission.
By the flag I guess you are Indian so you are visa national... The worst is that they will hold you and send you back but otherwise you might get limited admission to collect your staff of you request it.

But it's risky...
