FRRO -justification for indian entry visa expired

Hi All,

My 2 yr India born child holding Briitsh passport entry visa expired on June 9th

I immediatly applied for OCI and they said FRRO should extend his India visa x1 and valid for min 90 days

Now FRRO is asking for justification letter for this delay and extension of his visa

Can someone suggest what can I explain them as we had thought of going to UK and applying OCI however we couldnt do it due to family issues and completely lost track . Surely they will impose penlty for overstay after his visa expiry
